Welcome to careersinpayroll.com (“the Platform”). By accessing or using the Platform, you (“the User”) agree to be bound by these Terms of Service (“Terms”), forming a legally binding agreement between you and Portfolio Payroll Limited (trading as careersinpayroll.com). If you do not agree with these Terms, you must not use the Platform.

1.     Job Board Ownership

a)     www.careersinpayroll.com is licensed to, owned and operated by Portfolio Payroll Limited (“Portfolio”). The Chartered Institute of Payroll Professionals (“CIPP”) brands the Platform as its official job board under a separate licensing arrangement but has no operational role, ownership interest, or involvement in the day-to-day management of the Platform.

b)     Job advertisements hosted on the Platform may be placed by:

                                       i.           Portfolio on behalf of its clients;

                                      ii.           Portfolio, branded as the client, as part of our “Exclusive Recruitment Solution” sold via the Platform

                                    iii.            Portfolio, branded as the client, from our RPO solution; or

                                    iv.            Clients directly, as purchased through the Platform.

2.     Account Registration

a.     To access the full features of the Platform, you must register for an account and provide accurate, complete, and up-to-date information. You are responsible for maintaining the confidentiality of your login credentials and for all activity carried out under your account.

b.     Registration is not available to other recruitment agencies, job aggregators, or businesses whose primary activity relates to employment introductions or staffing services.

c.     You must notify us promptly if you become aware of any unauthorised use of your account.

3.     Job Listings

a.     Clients may post job listings on the Platform directly, subject to these Terms.

b.     Your first job posting only will be reviewed and approved by Portfolio before it goes live, to ensure compliance with these Terms. Portfolio aims to complete this review by the end of the same working day, but reserves up to two (2) business days to do so.

c.     Each job listing will remain live on the Platform for a period of thirty (30) days from the date of activation, after which it will be automatically removed.

d.     All job listings must be accurate, lawful, and compliant with all applicable laws and regulations, including (without limitation) equality and non-discrimination legislation.

e.     You are solely responsible for the content of your job listings and any consequences arising from inaccurate, misleading, or unlawful content.

f.       Portfolio reserves the right to remove any job listing at its sole discretion if it does not comply with these Terms, without liability to you.

4.     Job Applications & Candidate Ownership

a)     When a candidate applies to your job listing through the Platform, that candidate is treated as exclusive to you for the full duration of the listing and for thirty (30) days following the date of their application (“Exclusivity Period”).

b)     After the Exclusivity Period, Portfolio reserves the right to contact and engage that candidate in connection with their broader job search.

c)     Where you are already engaged with Portfolio under a separate recruitment agreement or preferred supplier arrangement, these Terms apply solely to your use of the Platform as an advertising medium. They do not affect, modify, or supersede any existing agreement between you and Portfolio.

d)     The following rules apply where Portfolio has submitted a candidate to you separately from the Platform:

                                           i.           Where Portfolio submits a candidate to you, and that candidate subsequently applies directly via the Platform, such application shall be deemed to constitute an Introduction by Portfolio. Our standard placement fee shall apply upon the successful placement of that candidate.

                                          ii.           Where a candidate applies directly via the Platform prior to any submission by Portfolio, and you are able to provide verifiable evidence of this (including but not limited to a dated application timestamp from the Platform or written correspondence predating Portfolio’s submission), no placement fee will be payable in respect of that candidate and Portfolio shall have no further involvement in that recruitment process.

5.     User Content

a.     You retain ownership of all job listings and other content you post on the Platform (“User Content”).

b.     By posting User Content to the Platform, you grant Portfolio a non-exclusive, royalty-free, worldwide licence to display, reproduce, and distribute your User Content solely for the purposes of operating and promoting the Platform.

c.     You warrant that your User Content does not infringe the intellectual property rights or other rights of any third party, and that you have all necessary rights and permissions to post it.

d.     You are solely responsible for the accuracy, legality, and completeness of all User Content you post.

6.     Communications and Marketing

a.     Portfolio may contact you for the purposes of account registration, onboarding, and resolving technical issues relating to the Platform.

b.     Where you have posted a job listing on the Platform, Portfolio Payroll reserves the right to contact you twenty-one (21) days after that listing is posted for the purpose of:

                                                         i.     assessing the performance of the Platform and your listing; and

                                                        ii.     introducing or offering Portfolio’s recruitment services on the basis of legitimate interests in supporting the User in finding a new employee

7.     Prohibited Activities

a.     You agree not to use the Platform for any unlawful purpose or in any way that may damage, disable, overburden, or impair the Platform or its functionality. Without limiting the foregoing, you must not:

                                                        i.     post false, misleading, or fraudulent content;

                                                       ii.     harass, intimidate, or threaten any other user, or any employee or representative of Portfolio Payroll, CIPP, or their affiliates;

                                                      iii.     attempt to gain unauthorised access to the Platform or any other user’s account;

                                                      iv.     use automated tools, including bots, spiders, or scrapers, to access the Platform or harvest user data; or

                                                       v.     violate any applicable law, regulation, or third-party right.

8.     Data Protection & Privacy

a.     Portfolio is the sole Data Controller for all personal data processed via the Platform, including candidate personal data submitted through job applications. Portfolio determines the purposes and means of processing such data and is solely responsible for ensuring that processing complies with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. Please refer to Portfolio’s Privacy Notice for full details.

b.     The CIPP acts solely as a brand licensor in respect of the Platform. It has no access to, and no involvement in the processing of, any personal data submitted via the Platform. The CIPP shall not be regarded as a Data Controller or Data Processor in respect of any such data.

c.     Where Portfolio shares candidate personal data with you for the purposes of a recruitment process, you become an independent Data Controller in respect of that data. You are solely responsible for ensuring your use of that data complies with all applicable data protection legislation, including UK GDPR. You must not use candidate personal data for any purpose other than assessing the candidate’s suitability for the relevant role, and must not retain it for longer than is necessary for that purpose.

9.     Fees and Payment

9.1 Pricing

The fees payable for job listings on the Platform are as follows:

·        Basic listing: £499 per advertisement;

·        Premium listing: £649 per advertisement; and

·        Multi-premium package (three advertisements): £1,499 in total.

All fees are stated exclusive of VAT, which will be charged at the applicable rate.

9.2 Payment

Fees must be paid in full at the time of purchase by credit or debit card via Stripe. By submitting payment, you authorise Portfolio to charge the applicable fee to your chosen payment method. Portfolio does not store your card details; all card data is processed and held by Stripe in accordance with PCI-DSS standards.

9.3 Payment by Invoice

Where you are unable to pay by card via Stripe, payment by invoice is available upon request. Please contact us at info@theportfoliogroup.co.uk prior to purchase. Please note that payment by invoice may delay the activation of your listing, as advertising credits will only be applied and your listing activated upon receipt of cleared payment in full.

9.4 Listing Activation

Your first listing is subject to a moderation review before going live. Portfolio Payroll aims to complete this by the end of the same working day, but reserves up to two (2) Business Days to do so.


All subsequent listings are activated immediately upon successful payment, provided your account remains in good standing.

9.5 Refunds and Cancellations

Fees are non-refundable once a listing has been activated, except where required by law. Where a first listing is rejected at moderation and cannot be remediated, a full refund will be issued within ten (10) Business Days. Portfolio reserves the right to remove any listing found to be in breach of these Terms following activation, without refund.

9.6 Changes to Pricing

Portfolio reserves the right to amend fees at any time. Changes will be communicated via the Platform and will apply to purchases made after the updated pricing is posted. Listings already active at the time of any change will not be affected.

9.7 Recruitment Services Credit

Where you engage Portfolio’s “Exclusive recruitment solution” via careersinpayroll.com within ninety (90) days of posting a job listing on the Platform, and Portfolio successfully places a candidate in that role, the fee paid for that listing will be credited in full against the final placement fee due. This credit applies to one listing per placement and will be itemised on the final invoice. It is not redeemable as cash and may not be carried forward or applied to future placements.

10. Term and Termination

10.1 Term

These Terms apply from the date you first access or use the Platform and continue for so long as your account remains active, unless terminated earlier in accordance with this clause.

10.2 Termination or Suspension by Portfolio

Portfolio may suspend or terminate your account immediately by written notice if:

                                           i)                   you commit a material breach of these Terms and, where capable of remedy, fail to remedy it within thirty (30) days of written notice requiring you to do so;

                                           ii)                  you provide false, misleading, or fraudulent information in connection with your account or any listing;

                                            iii)                you become insolvent, enter administration, make any arrangement with creditors, have a receiver appointed, or go into liquidation (other than for the purposes of a solvent reconstruction); or

                                               iv)            Portfolio is required to do so by law, regulation, or court order.


Portfolio Payroll may also suspend your account on a temporary basis while investigating any suspected breach, without this constituting termination.

10.3 Termination by You

You may close your account at any time by contacting us in writing at info@theportfoliogroup.co.uk. Closure does not entitle you to a refund of fees already paid. Your obligations in respect of candidate data and any accrued payment liabilities shall survive closure.

10.4 Effect of Termination on Live Listings

Upon termination or suspension of your account for any reason:

                                               i)                   all active listings will be removed from the Platform immediately and will no longer be visible to candidates, regardless of any remaining paid duration;

                                               ii)                 no refund will be issued in respect of any unexpired listing period;

                                               iii)               all rights granted to you under these Terms will immediately cease; and

                                               iv)                you must immediately cease all use of the Platform.

10.5 Survival

The following provisions survive termination: clause 4 (Candidate Ownership), clause 5 (User Content), clause 8 (Data Protection and Privacy), clause 12 (Indemnification), clause 13 (Limitation of Liability), and clause 14 (Governing Law and Jurisdiction), together with any accrued payment obligations.

10.6 Platform Discontinuation

Portfolio reserves the right to modify, suspend, or permanently discontinue the Platform at any time. In the event of permanent discontinuation, Portfolio will use reasonable endeavours to provide at least thirty (30) days' advance written notice to registered users where practicable.

11     Modifications to the Platform

Portfolio reserves the right to modify, suspend, or discontinue any aspect of the Platform at any time without prior notice. We may also impose limits on certain features or restrict your access to parts or all of the Platform without liability or notice.

12     Indemnification

You agree to indemnify and hold Portfolio, its affiliates, officers, directors, employees, agents, and representatives harmless from and against any claims, damages, liabilities, losses, and expenses arising out of your use of the Platform, your User Content, or your violation of these Terms.

13     Limitation of Liability

To the maximum extent permitted by applicable law, portfolio payroll limited shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the platform, even if we have been advised of the possibility of such damages.

14     Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United Kingdom, without regard to its conflicts of law principles. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in the United Kingdom.

15     Changes to the Terms

Portfolio may update these Terms from time to time. Any changes will be posted on this page, and the “Effective Date” at the bottom will reflect the most recent revision. Your continued use of the Platform after the revised Terms are posted constitutes your acceptance of the changes.

Candidates

Welcome to careersinpayroll.com (“the Platform”). By accessing or using the Platform, you (“the Candidate”) agree to be bound by these Terms of Service (“Terms”), forming a legally binding agreement between you and Portfolio Payroll Limited (trading as careersinpayroll.com) (“the Owner”). If you do not agree with these Terms, please do not use the Platform.

1.   Job Board Ownership

www.careersinpayroll.com is licensed to, owned, and operated by Portfolio Payroll Limited (“Portfolio”). The Platform hosts job advertisements placed by Portfolio on behalf of its clients, as well as advertisements purchased directly by clients and members of CIPP.

2.   Account Registration

To apply for roles on the Platform, you will need to create an account. You agree to provide accurate and complete information during the registration process. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us promptly if you become aware of any unauthorised use of your account.

3.   Privacy & Consent to Contact

By creating an account and applying for roles via the Platform, you acknowledge that you have read and agree to Portfolio’s Privacy Notice, which sets out how we collect, use, store, and share your personal data.

By submitting your details and CV via the Platform, you expressly consent to Portfolio contacting you for the purpose of your job search, including in relation to roles that may not be advertised on the Platform, whether during or after the period in which any specific application remains active.

You may withdraw your consent at any time by contacting us using the details in the Contact Us section below. Withdrawal of consent will not affect the lawfulness of any processing carried out prior to withdrawal.

4.   Your Content

The Platform allows you to upload your CV and supporting documents for the purpose of applying for roles. You retain full ownership of all documents you upload. Any CV or documents you provide will only be shared with prospective employers in connection with your job search, and in accordance with Portfolio’s Privacy Notice. We will not share your documents publicly or use them for any purpose beyond your job search without your express consent.

You agree that all content you upload will be accurate, truthful, and your own. You are solely responsible for ensuring your CV and any supporting documents do not infringe the rights of any third party.

5.   Prohibited Activities

You agree not to use the Platform for any unlawful purpose or in any way that could damage, disable, overburden, or impair the Platform’s functionality. You also agree not to:

•      Submit false, misleading, or fraudulent information or misrepresent your qualifications or experience.

•      Harass, intimidate, or threaten other users, or Portfolio, CIPP, or their respective personnel.

•      Attempt to gain unauthorised access to the Platform or other users’ accounts.

•      Use automated means, including bots, spiders, or scrapers, to access the Platform or collect information.

•      Violate any applicable laws, regulations, or third-party rights.

6.   Data Protection & Privacy

Portfolio is the sole Data Controller for all personal data processed via the Platform, including any personal data you submit when creating an account or applying for roles. Portfolio determines the purposes and means of processing such data and is solely responsible for ensuring that processing complies with the UK General Data Protection Regulation (UK GDPR) and the Data Protection Act 2018. 8.   Indemnification

You agree to indemnify and hold Portfolio its affiliates, officers, directors, employees, and representatives harmless from and against any claims, damages, liabilities, losses, and expenses arising out of: (a) your use of the Platform; (b) any content you upload, including your CV or supporting documents; or (c) your violation of these Terms or any applicable law.

9.   Modifications to the Platform

Portfolio reserves the right to modify, suspend, or discontinue any aspect of the Platform at any time without prior notice. We may also impose limits on certain features or restrict your access to parts or all of the Platform without liability or notice. In the event of permanent discontinuation of the Platform, Portfolio will use reasonable endeavours to provide at least thirty (30) days’ advance written notice to registered account holders where practicable.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Portfolio shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or in connection with your use of the Platform, even if we have been advised of the possibility of such damages. Without limiting the foregoing, we cannot guarantee uninterrupted access to the Platform and we are not responsible for any loss arising from the Platform being temporarily unavailable. We are not responsible for the accuracy or completeness of job listings posted by third-party clients or CIPP members, and we make no representation that any particular role is suitable for you. Use of the Platform does not guarantee you will receive a job offer or be placed in employment. Nothing in these Terms limits our liability for death or personal injury caused by our negligence, fraud, or any other liability that cannot be excluded by law.

11. Governing Law and Jurisdiction

These Terms shall be governed by and construed in accordance with the laws of the United Kingdom. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of the United Kingdom.

12. Changes to the Terms

Portfolio may update these Terms from time to time. Any changes will be posted on this page, and the “Effective Date” at the bottom will reflect the most recent revision. Your continued use of the Platform after the revised Terms are posted constitutes your acceptance of the changes.
